As between you and Nourio and to the extent permitted by applicable law, you (a) retain ownership of Input and (b) own Usage Results. We hereby assign to you all our property and other rights, including ownership rights, if any, in Usage Results.

We may use Content to provide, maintain, develop, and improve our Services, comply with applicable laws, ensure compliance with our terms and policies, and maintain the security of our Services.
Accuracy
Artificial intelligence and machine learning are rapidly evolving fields of research. We continuously work to improve our Services to make them more accurate, reliable, safe, and useful. Given the probabilistic nature of machine learning, use of our Services may in some situations produce results that inaccurately reflect real facts about nutrition, calories, or nutrients.
By using our Services, you understand and agree that:
- Usage results are not always accurate. You should not consider Usage Results from our Services as the sole source of truthful or factual information about nutrition or substitute them for professional advice;
- before using Usage Results from the Services or providing others access to such results, you should review Usage Results for accuracy and suitability for your use case, including through human verification;
- you may not use Usage Results related to nutrition for any purpose if it may have legal or material consequences, including making decisions regarding health, dietetics, allergies, or other important matters without consulting a qualified professional;
- our Services may produce incomplete, incorrect, or offensive Usage Results that do not reflect the views of Nourio.

Information provided in the app is for informational purposes only and does not replace professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional or dietitian with any questions regarding your health, nutrition, or medical condition.
You may not use our Services to make decisions regarding health, dietetics, allergy treatment, or other medical matters without consulting a qualified professional.
Our Intellectual Property Rights
We and our affiliates are the owners of all property and other rights, including ownership rights, in the Services. You may use our name and logo only in accordance with our brand usage guidelines.
Paid Accounts
Billing
If you purchase Services, you must provide complete and accurate payment information, including a valid payment method. For paid subscriptions, we automatically charge fees using your payment method on the agreed regular subscription renewal date until you cancel. You are responsible for paying all applicable taxes, and we will charge taxes when required. If payment is not made, we may downgrade your account level or suspend your access to our Services until payment is received.
Cancellation
You may cancel a paid subscription at any time. Payments are non-refundable, except as required by law. These Terms do not override mandatory local law requirements regarding your cancellation rights.
Changes
We periodically change prices. If we increase the subscription price, we will notify you at least 30 days in advance, and the increased price takes effect at the next renewal. You may cancel your subscription if you do not agree with the increased price.
Termination and Suspension
Termination
You may terminate your use of our Services at any time. We reserve the right to suspend or terminate your access to our Services or delete your account if we find that:
- you have violated these Terms or our usage rules;
- we are required to do so to comply with legal requirements;
- your use of our Services may create a risk for Nourio, our users, or others or the likelihood of harm to them.
We may also terminate your account if it remains inactive for more than one year and you do not have a paid account. In such cases, we will notify you in advance.
Appeal
If you believe we have suspended or terminated your account in error, you may appeal our actions by contacting support.
Discontinuation of Services
We may decide to discontinue our Services and in such cases will notify you in advance and refund fees for Services you have prepaid but not used.
Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS". EXCEPT TO THE EXTENT PROHIBITED BY LAW, WE, OUR AFFILIATES, AND LICENSORS MAKE NO WARRANTIES (EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE) WITH RESPECT TO THE SERVICES AND DISCLAIM ALL WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, NON-INFRINGEMENT, AND QUIET ENJOYMENT, AND WARRANTIES ARISING OUT OF ANY COURSE OF DEALING OR TRADE USAGE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE, THAT CONTENT WILL BE SECURE OR NOT LOST OR ALTERED.
YOU ACCEPT AND AGREE THAT YOU USE USAGE RESULTS FROM OUR SERVICE AT YOUR OWN RISK, DO NOT CONSIDER THEM AS THE SOLE SOURCE OF TRUTH OR FACTUAL INFORMATION ABOUT NUTRITION, AND DO NOT SUBSTITUTE THEM FOR PROFESSIONAL ADVICE.
Limitation of Liability
NEITHER WE NOR OUR AFFILIATES OR LICENSORS WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOST PROFITS, GOODWILL, USE, OR DATA, AND OTHER LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRIOR TO THE CLAIM, OR $100. THE LIMITATIONS IN THIS SECTION APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

These Terms constitute the entire agreement between you and Nourio regarding the Services and supersede any prior or current agreements between you and Nourio.
Governing Law
These Terms are governed by the laws of Ukraine and applicable international agreements. All claims arising from or related to these Terms shall be subject to review in accordance with applicable law.
